Welcome to Diary! These terms of service ("Terms") apply to your access and use of Diary ("we," "us," or "our") digital journaling platform ("Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

2. Service Information

Diary provides a digital place for users to dump their thoughts, feelings, ideas, or whatever else they want into. Diary offers two tiers of service:

  • Starter Tier: Free forever
  • Plus Tier: Monthly charge, no free trial

3. User Responsibilities

Users are not required to adhere to any specific responsibilities aside from:

  • Content: Users are responsible for the content they write.
  • Data Security: Users are responsible for keeping their account credentials secure.
  • Compliance: Users must comply with all applicable laws and regulations.

Restrictions:

  1. Users must not use the Service for any illegal or unauthorized purpose.
  2. Users must not, in the use of the Service, violate any laws in their jurisdiction.
  3. Users must not exchange, sell, or otherwise transfer their account.

Content written by users is encrypted at rest and in transit, meaning we cannot monitor the types of content written.

4. Payments and Billing

  • Payment Processing: Monthly via Stripe.
  • Billing Management: Users can manage their billing preferences at Billing Preferences.
  • Refunds: Discussed on a case-by-case basis by emailing hi@kyle.so.

5. Account Information

  • Account Creation: Users need to provide either an email or a social connection (Google or GitHub).
  • Account Termination: Users can delete their account and all associated data by signing in, navigating to "account settings," then "security," and clicking "delete account."

6. Service Availability and Support

  • Uptime Guarantee: No uptime guarantee is provided.
  • Support: Available via email (hi@kyle.so) and Twitter DMs (@kyledickeyy).

7. Privacy and Data Protection

For information on how we handle user data and privacy, please refer to our Privacy Policy.

8. Modifications to the Terms

We may update these Terms from time to time. Users will be notified of updates on the platform and via email.

9. Governing Law

These Terms are governed by the laws of the United States.
